Terms of Use Introduction

Welcome to E&V, a brand operated by YQY INTERNATIONAL CONSULTING (“we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our platform and professional compliance services. By engaging our services—including but not limited to VAT registration, VAT filing, and European EPR (Extended Producer Responsibility) compliance—you agree to be bound by these Terms.

Description of Compliance Services

E&V provides a specialized one-stop platform designed to assist global sellers in navigating the regulatory landscape of the European market. Our core services include:

  • VAT Services: Registration and recurring filing for European Union countries and the UK.
  • EPR Compliance: Registration and reporting for Packaging, Batteries, and WEEE (Waste Electrical and Electronic Equipment) across various European jurisdictions.
  • Data Integration: Providing a bridge between your marketplace accounts (Amazon, eBay, etc.) and European tax and environmental authorities.

All services are provided on an “as is” and “as available” basis. While we provide the tools for compliance, E&V does not perform automated error-checking on the raw data you provide; the accuracy of submissions remains your responsibility.

Account Obligations and Data Accuracy

  • Authorized Representation: When you create an account, you represent that you have the authority to bind the entity or firm you represent to these Terms.
  • Information Integrity: You are responsible for providing true, accurate, and complete information required for VAT and EPR filings. Any penalties incurred due to inaccurate data provided by you are your sole responsibility.
  • Security: You must maintain the confidentiality of your login credentials. We strongly recommend enabling two-step authentication where available.

Fees, Billing, and Renewals

  • Subscription Plans: Access to our compliance platform generally requires a recurring subscription fee based on the countries and service types selected.
  • Timely Payments: Services may be suspended or terminated if payments are not received in accordance with your chosen pricing plan.
  • Activation Period: Please note that integration with tax authorities and EPR registries often requires manual processing and document verification, which may take several days. E&V is not liable for filing delays during this initial activation window.

Data Privacy and Regulatory Use

  • Data License: You grant us a license to use, store, and analyze your data strictly to facilitate your compliance filings and improve our service functionality.
  • Confidentiality: We implement industry-standard safeguards to protect your sensitive business information and expect you to do the same for any confidential platform details we share.

Termination and Data Retention

  • Cancellation: You may terminate your subscription by providing one month’s written notice to info@eprvat.com.
  • Breach: We reserve the right to terminate access immediately if you breach these Terms or fail to meet payment obligations.
  • Record Retention: Upon termination, we may archive your data in accordance with statutory tax and accounting requirements before permanent deletion.

Limitation of Liability and Indemnity

  • No Professional Advice: E&V is a compliance service provider, not a law firm or a professional accounting firm. Our platform should not be viewed as a substitute for professional legal or tax advice.
  • Liability Cap: To the extent permitted by law, our total aggregate liability is limited to the fees you paid for your subscription in the 12 months preceding any claim. We are not liable for loss of profit or indirect damages arising from regulatory changes or marketplace deactivations.
  • Indemnity: You agree to indemnify E&V against any third-party claims or regulatory penalties resulting from your misuse of the service or provision of false information.

Governing Law and Contact Information

These Terms are governed by the laws of France. Any disputes will be resolved through binding arbitration or the appropriate courts in Paris.

Payment and Service Initiation

Service Activation: All compliance services (EPR, VAT, etc.) are only considered activated upon the receipt of full payment (or the agreed-upon initial deposit) and the submission of all required documentation by the User.

    Invoicing: For custom compliance projects, E&V will issue a Proforma Invoice via PayPal or bank transfer. The payment of such invoice constitutes the User’s acceptance of these Terms.

    Refund and Cancellation Policy

    Non-Refundable Milestones: Once E&V has initiated the application process with the relevant European authorities (e.g., submitted a LUCID application or VAT registration form), no refunds shall be issued for the service fee or official administrative fees already incurred.

      Official Fees: Any fees paid to government bodies or environmental organizations (Recycling fees, Registration fees) are strictly non-refundable once paid by E&V on behalf of the Client.

      Processing Delays: The User acknowledges that government processing times (ranging from 1-3 days to 2 months depending on the country) are beyond our control. Delays on the part of the authorities do not constitute a valid reason for a refund or payment dispute.

      Dispute Resolution for Digital Services

      No Chargebacks: The User agrees not to initiate a chargeback or payment dispute with their payment provider (PayPal, Stripe, or Bank) without first attempting to resolve the issue directly with E&V.

        Evidence of Service: In the event of a dispute, E&V reserves the right to provide payment providers with evidence of work performed, including but not limited to: draft registration forms, official submission receipts, and communication logs with authorities.
